Article 2 – Definitions
In these General Terms and Conditions, the following terms shall have the meanings set forth below:
Kweekotheek
The company that offers products and services via www.kweekotheek.nl.
Customer
Any natural person or legal entity who enters into an agreement with Kweekotheek.
Consumer
A natural person who acts for purposes outside his trade, business, craft or profession.
Business customer
Any natural person or legal entity who acts in the exercise of a profession or business.
Agreement
Any agreement between Kweekotheek and the customer concerning the sale and delivery of products and/or services.
Product
All goods offered by Kweekotheek, including grow lights, grow tents, grow cabinets, accessories, parts and other items.
Website
www.kweekotheek.nl and all associated web pages.
Article 3 – Applicability
- These General Terms and Conditions apply to all offers, quotations, orders and agreements of Kweekotheek.
- By placing an order, the customer declares to have read and agreed to these General Terms and Conditions.
- Deviations from these General Terms and Conditions are only valid if confirmed in writing by Kweekotheek in advance.
- If one or more provisions of these terms and conditions prove to be wholly or partially void or are annulled, the remaining provisions shall remain in full force and effect.
- Kweekotheek reserves the right to amend these General Terms and Conditions. For existing agreements, the terms and conditions that applied at the time the agreement was concluded shall remain applicable.
Article 4 – Offer and agreement
- All offers from Kweekotheek are without obligation.
- Obvious mistakes, typesetting errors, pricing errors or programming errors do not bind Kweekotheek.
- Images, illustrations, colors, dimensions and other product information on the website are displayed as accurately as possible. Small deviations may occur and do not give the right to dissolve the agreement or claim compensation.
- An agreement is concluded as soon as Kweekotheek has confirmed the order or as soon as Kweekotheek has started the execution of the order.
- Kweekotheek reserves the right to refuse an order or to request additional information if there is a valid reason for doing so, for example in case of suspected abuse, fraud or an obvious mistake.
- If an ordered product unexpectedly turns out to be unavailable, Kweekotheek will inform the customer of this as soon as possible. Any amounts already paid will be refunded as soon as possible in that case.
Article 5 – Product information
- Kweekotheek makes every effort to describe all products as completely and accurately as possible. Product descriptions, images, technical specifications and other information are intended to provide the best possible impression of the product.
- Images are for illustration purposes only. Colors, dimensions and details may deviate slightly from the actually delivered product due to screen settings or product changes.
- Technical specifications, dimensions, weights and performance are based on information from manufacturers or our own measurements. Obvious mistakes or typing errors cannot lead to compensation or dissolution of the agreement.
- Kweekotheek reserves the right to change product specifications or product designs if this is necessary due to technical developments, changes by the manufacturer or improvements to the product. This will, of course, be done without prejudice to the essential characteristics of the product.
- For optimal use of our products, we recommend carefully reading the enclosed manual and following the recommended safety instructions.
Article 6 – Prices
- All prices on the website are stated in euros (€).
- Unless expressly stated otherwise, all prices include VAT for private customers.
- Any shipping costs will be clearly displayed before the order is finally placed.
- Kweekotheek reserves the right to change prices at any time. A price change does not affect agreements already concluded.
- Obvious pricing errors or input errors do not bind Kweekotheek. If such an error is discovered, Kweekotheek will inform the customer of this as soon as possible. In that case, the customer has the right to cancel the order free of charge.
- Any promotions, discount codes and offers are only valid during the indicated promotion period and while stocks last.
Article 7 – Payment
- Payment must be made via one of the payment methods offered during the ordering process.
- An order will be processed after payment has been received or when a chosen payment method has given approval for this.
- Kweekotheek uses a secure payment environment. Payments are processed by a professional payment provider.
- If a payment is refused or cancelled, Kweekotheek reserves the right not to execute the order.
- For orders on account or business deliveries, additional conditions may apply. Kweekotheek reserves the right to perform a credit check or to demand prepayment.
Article 8 – Delivery
- Kweekotheek strives to ship orders as quickly as possible. The expected delivery time is stated on the website or during the ordering process.
- Stated delivery times are indicative and do not count as a strict deadline. Exceeding a delivery time does not automatically entitle the customer to compensation.
- If an order is unexpectedly delayed, Kweekotheek will inform the customer of this as soon as possible.
- If delivery proves to be permanently impossible, the customer is entitled to a refund of amounts already paid.
- Delivery takes place at the delivery address specified by the customer. The customer is responsible for correctly entering this information.
- The risk of damage or loss of products passes to the consumer at the time of delivery. For business customers, the risk passes at the moment the goods are handed over to the carrier, unless mandatory law dictates otherwise.
- If a package is delivered visibly damaged, we advise the customer to report this directly to the carrier and to contact Kweekotheek as soon as possible. We will then work together to find a suitable solution.
- If a package is returned due to incorrect address details, refusal or failure to collect the shipment, Kweekotheek may charge the actual shipping costs again before a new shipment takes place.
Article 9 – Right of withdrawal (14-day cooling-off period)
Good to know
We do our utmost to present our products as completely and clearly as possible. However, it may happen that a product does not fully meet your expectations. Therefore, as a consumer, you have the legal right to withdraw your purchase within 14 days without giving reasons.
9.1 Cooling-off period
As a consumer, you have the right to withdraw from the agreement within 14 days after receipt of the product without giving reasons.
9.2 Reporting withdrawal
Do you want to exercise your right of withdrawal? Please notify us within the cooling-off period, preferably by email or via the contact form on our website.
After your notification, you have another 14 days to return the product to us.
9.3 Refund
After receipt and inspection of the return shipment, we will refund the purchase amount, including any standard shipping costs paid for the original delivery, as soon as possible. This will happen no later than 14 days after we have received the return shipment or after you have demonstrated that the product has been shipped.
The refund will be made via the same payment method as used for the original order, unless otherwise agreed.
9.4 Exceptions
The legal right of withdrawal does not apply to products manufactured according to the customer's specifications or specially ordered for the customer, insofar as the law provides for this.
Article 10 – Returns
Our principle
We want returns to be simple and clear. Do you have questions about a return shipment? Please feel free to contact us. We are happy to help you.
10.1 Condition of the product
During the cooling-off period, you may view and assess the product as you would in a physical store.
If the product has been used more than necessary to establish its nature, characteristics and functioning, there may be a depreciation in value. According to the law, we may deduct this depreciation from the amount to be refunded.
10.2 Packaging
Preferably return the product complete, including accessories, manuals and – if reasonably possible – in its original packaging.
Missing or damaged packaging does not automatically lead to refusal of the return shipment, but may affect any depreciation in value if this causes damage to the product.
10.3 Return costs
Unless otherwise agreed, the costs for returning are for the account of the customer.
If a product is delivered incorrectly, damaged or defective, Kweekotheek will, of course, bear the return costs.
10.4 Special orders
Products that have been specially ordered or manufactured for the customer and that are not available from stock can only be returned if the law requires this or if Kweekotheek explicitly agrees to this.
Article 11 – Warranty and legal conformity
Quality comes first
We only supply products that we expect to meet the quality you can reasonably expect from them.
11.1 Legal warranty
For consumers, the legal warranty always applies. This means that a product must meet what you can reasonably expect from it.
If a product does not meet these expectations, you are entitled to an appropriate solution, such as repair, replacement or – if that is not possible – (partial) refund of the purchase amount.
11.2 Manufacturer's warranty
In addition, a manufacturer's warranty applies to many products.
The duration and conditions of this vary per manufacturer and are, if applicable, stated on the product page or supplied with the product.
The manufacturer's warranty does not affect your legal rights as a consumer.
11.3 Warranty procedure
Is there a problem with a product? Please contact us as soon as possible.
We will assess the situation together with you and always look for a suitable solution. Depending on the product, this may consist of:
- repair;
- replacement;
- delivery of missing parts;
- or another suitable solution.
11.4 Exclusions
Warranty does not apply to damage caused by, among other things:
- incorrect or improper use;
- incorrect installation;
- normal wear and tear;
- insufficient maintenance;
- modifications or repairs carried out without the permission of Kweekotheek or the manufacturer;
- damage due to external influences such as fire, moisture, lightning strike or fall and impact damage.
Article 12 – Complaints
We believe it is important that you are satisfied with our products and services.
Are you not satisfied with something? Let us know. We are happy to work with you to find a suitable solution.
12.1 Submitting a complaint
You can submit a complaint via:
- email;
- phone;
- or the contact form on our website.
Describe the complaint as clearly as possible and, if possible, add photos or other relevant information.
12.2 Handling
We will confirm receipt of your complaint as soon as possible.
We strive to answer every complaint substantively within 14 days.
If more time is needed, we will inform you of this and indicate when you can expect a substantive response.
12.3 Disputes
Should a complaint unfortunately not be resolved to your satisfaction, you can make use of the possibilities offered by Dutch law for this purpose.
Article 13 – Liability
We do everything we can to carefully select our products, keep our website up to date and execute orders correctly.
Should something nevertheless go wrong, we will always first look for a suitable solution together.
13.1 Limitation of liability
To the extent permitted by law, the liability of Kweekotheek is limited to direct damage resulting from an attributable shortcoming.
Any liability for indirect damage, including consequential damage, loss of profit, missed savings or business stagnation, is excluded, unless there is intent or conscious recklessness.
13.2 Maximum compensation
If Kweekotheek is liable, the liability is limited to a maximum of the amount paid for the relevant product or order, unless the law dictates otherwise.
13.3 Product use
The customer remains responsible for the correct use, correct installation and correct maintenance of the delivered products.
Kweekotheek is not liable for damage arising from use that deviates from the manual, safety regulations or applicable laws and regulations.
Article 14 – Force majeure
14.1 Kweekotheek is not obliged to fulfill its obligations if fulfillment is temporarily or permanently impossible due to force majeure.
14.2 Force majeure means any circumstance beyond Kweekotheek's reasonable control that wholly or partially prevents the performance of the agreement.
This includes, but is not limited to:
- strikes;
- fire;
- floods;
- extreme weather conditions;
- pandemics;
- war or government measures;
- disruptions at carriers;
- failure of internet or communication networks;
- disruptions in payment traffic;
- delays at suppliers.
14.3 During a period of force majeure, Kweekotheek's obligations are suspended.
14.4 If the force majeure lasts longer than thirty days, both parties have the right to dissolve the agreement in writing, without any obligation to compensate for any damage.
Article 15 – Privacy
15.1 Kweekotheek processes personal data exclusively in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
15.2 Personal data is used exclusively for:
- processing orders;
- delivery of products;
- customer service;
- warranty handling;
- legal administrative obligations;
- communication about the agreement.
15.3 Personal data is never sold to third parties.
15.4 For detailed information about the processing of personal data, Kweekotheek refers to the separate Privacy Statement on the website.
15.5 If you have given permission for receiving newsletters or offers, you can easily withdraw this permission at any time.
Article 16 – Intellectual property
16.1 All texts, images, photos, videos, logos, product descriptions, designs and other content on the Kweekotheek website are the property of Kweekotheek or are used with the permission of the rightful owner.
16.2 Without prior written permission, it is not permitted to copy, publish, distribute or otherwise use this information, in whole or in part, except for personal and non-commercial use.
16.3 The use of trade names, logos or visual material of Kweekotheek on other websites, advertisements or sales platforms is only permitted after prior written permission.
Article 17 – Website and disclaimer
17.1 Kweekotheek takes great care in the content of its website.
Despite this care, it may happen that information is incomplete, outdated or incorrect.
17.2 Obvious typing errors, pricing errors or programming errors can always be corrected and do not give the right to delivery at an incorrect price or under incorrect conditions.
17.3 Product information, technical data and images have been compiled with care, but may differ from the final design of a product.
17.4 Kweekotheek reserves the right to adjust or update the content of the website at any time.
17.5 References to external websites are offered for information purposes only. Kweekotheek is not responsible for the content or operation of these websites.
Article 18 – Applicable law and disputes
18.1 All agreements between Kweekotheek and the customer are exclusively governed by Dutch law.
18.2 Do you have a complaint or dispute? Please contact us first. In almost all cases, we can come to a suitable solution together.
18.3 If a dispute cannot be resolved by mutual agreement, it can be submitted to the competent court in accordance with Dutch law.
Final provision
These General Terms and Conditions have been compiled with the greatest care.
Should a provision prove to be wholly or partially invalid, the remaining provisions shall remain in full force and effect. The relevant provision will in that case be replaced by a provision that is as close as possible to the intention of the original provision.
